By booking services or renting equipment from Move Earth LLC ("Company"), the customer ("Renter") agrees to the terms set forth below. These terms apply to all jobs, rentals, hauling, and on-site work performed by the Company.
Rental periods begin at the time of delivery or pickup and end when the equipment is returned in clean, fueled, working condition. Late returns are billed at the daily rate. Damage, missing parts, and excessive cleaning are billed to the Renter at cost plus a service fee.
The Renter is responsible for ensuring all operators are trained, of legal age, and physically capable of operating the equipment safely. The Renter assumes all responsibility for safe operation, site conditions, and underground utilities. Always call 811 before digging.
The Company is not liable for damage to underground utilities, septic systems, irrigation, landscaping, or unmarked structures. The Renter agrees to indemnify and hold harmless the Company from any claims arising out of the use of rented equipment or from work performed at the Renter's direction.
Move Earth LLC carries general liability insurance. Renters are required to maintain their own insurance covering equipment in their possession and any damages caused by its operation.
Jobs cancelled with less than 24 hours' notice may be subject to a service fee equal to one (1) hour of labor or the equivalent daily rental rate.
Payment is due at booking for all rentals. Late payments on services may incur additional interest at the maximum rate allowed per law.
This agreement is governed by the laws of the state in which the work is performed. Any disputes will be resolved in the courts of that state.
